On the one hand, as member of the IAEL (International Association of Entertainment Lawyers), we will contribute, in our capacity as reporter for France, to the annual book of the IAEL, whose next edition shall be devoted to private copy.
On the other hand, as in the past, we will be pleased to host the Digital Workshop in front of an audience of MIDEM professionals, on January 21, 2007.
Traditionally, we host this Workshop with our colleague Jeff LIEBENSON, of HERRICK FEINSTEIN LLP a law firm based in New York.
We shall not fail, amidst various international issues, to also present an analysis of the new French copyright law of August 3, 2006.

The mission of the association is to drive a network of eco-technologies as well as working groups of eco-actors and to be part of the original network in the environmental field. Pierre Briglia, President at the time of APPEL, sought a means to federate the various partners in this area and to promote awareness of their activities : an event which would bring together professionals in the environmental field, eco-actors, researchers, industrialists and public bodies. The concept of the Summer University of the Environment 2005 was born. The Summer University of the Environment is a place for exchange of views, in the relaxed style of American Summer Universities. The personal status of managers in Europe is a major preoccupation for multinational groups which have to organise the geographical mobility of their executives. This question was the key theme of a working session organised by BLA on 23 September 2005 with the European members of the Meritas network.

A historical debate on copyrights took place on the French Assemblée Nationale a fortnight before the end of year 2005. Few deputies were present in the hemicycle to examine the sensitive and crucial points of the transposition of the directive dated May 22nd 2001, relative to the harmonisation of certain aspects of copyrights and neighbouring rights : the expression of only 58 votes lead to the ratification of a certain number of very contested amendments, centred on Peer to Peer , which would have a decisive impact on our culture’s future.

After having started her career as a Jurist for production agencies and companies in the cultural sector (notably in the field of cinematographic and musical production), Anne-Marie Pecoraro is now Partner Lawyer of Bignon Lebray & Associés ( 115 lawyers, 30 of whom are partners, located in Paris, Lyon, Lille and Aix-Marseille).

“Tax Law news for 2006”. On Wednesday January 18th 2006 (from 8h30 to 10h00) in our Parisian office, then on Monday January 23rd in Aix en Provence, on Tuesday January 24th in Lyon, and on Thursday 26th January in Lille.Our presentation shall be centred on following themes : > Exoneration of capital gains generated by stock transfers performed by individuals, and new perspectives offered by this regulation ; > Stiffening of financial costs’ tax deductibility, and application of new sub-capitalization ratios ; > Reduction of the professional tax’s scheme, and presentation of the new reform’s great lines ; > New accountancy regulations’ consequences on taxation, notably concerning mergers operations and assimilated operations (assets’ transcription and remuneration, merger’s “boni and mali”, dissolution without liquidation : consequences on taxation) ;
We shall also evoke other new elements which are important for companies, their managers and their shareholders :
- adaptation of the mother-company and subsidiary scheme to preference shares ; - reduction of tax exoneration’s conditions of application for expatriated employees ; - adjustment of the tax’s credit system in case of donation to research ; - taxation’s extension on professional vehicles – the so-called “fiscal shield” mechanism ; (direct taxations’ limitation), and the recent jurisprudence relative to fiscal abuses and territoriality of companies’ taxation at European level.

Through a chronological presentation of several tax control phases, we suggest attitudes, actions and arguments adapted to successive tactics chosen by controlled taxpayers and companies. How to prepare the controller ‘s interventions ? How to define and implement defence strategies ? Which opportune and efficient arguments (relative to law interpretation and procedure) can be used ? When is it opportune to present them ? The tax control’s result depends on all these arguments.
