At the end of the year 2005, a historical debate on copyright took place in the French Assemblée Nationale. Few deputies were present in the chamber to study sensitive and crucial points raised by the transposition of the directive dated May 22nd 2001 concerning the harmonisation of certain copyrights and neighbouring rights aspects : the expression of only 58 votes led to the ratification of a certain number of very contested amendments, centred on Peer-to-Peer transfer of media , which will have a decisive impact on our culture’s future.
Anne-Marie Pécoraro will have the honour to participate in two conferences on this topic :

The purpose of this review is to offer a brief presentation of contradictions, controversies and dilemmas which shake the world of literary and artistic property, faced with drastic technological changes. Partial solutions are apparent, whereas discussions about the “DADVSI law” project raise impassioned debates, and reveal the difficulty in remaining objective. See the review. We are pleased to inform you that, in 2007 as well, our firm will be present within the framework of the MIDEM. On the one hand, as a member of the International Association of Entertainment Lawyers, we will contribute to the yearly book published by the IAEL, which next issue will be dedicated to private copy. On another hand, like in previous years, we will have the pleasure to conduct on January 22nd 2007 the Digital Workshop before the MIDEM’s professionals. Traditionally, we conduct this workshop with our colleague Jeff LIEBENSON of the firm HERRICK FEINSTEIN LLP, New York. Among other international topics, we will analyze the new French law concerning copyrights dated August 3rd 2006. |

Conference of 23 March 2006 in London : Media litigation abroad, perils and insurance coverage

Anne-Marie Pecoraro, partner, and Richard Ryde, consultant, of the Paris office of Bignon Lebray et Associés will be panelists at a conference to be held in London on 23 March 2006 entitled Media litigation abroad-Perils and insurance coverage Litigations involving media companies are evolving at the international level. If it is now a commonplace to describe the globalization of information flows, whether by way of new technologies or through more traditional channels (i.e. the printed media), it is much more unusual to export litigations to certain countries, in order to benefit from more flexible regulations with regard to the press. English media companies in particular are preferably sued in France for slander or infringement of privacy. Therefore, the choice of jurisdiction and applicable law becomes strategically vital for any justiciable party who is a 'forum shopping' enthusiast. Consequently, the risks weighing on these companies and resulting from the application of various legislations and legal practices (with regard in particular to damages) must be apprehended and evaluated.

Rose d'Or 2006 Festival : a conference attended by over 3000 professionals in television and mobile telephone operators, on April 28 in Lucerne, Switzerland. Our intellectual property, technologies and entertainment law department intervened on challenges and opportunities for content providers in the framework of mobile telephone uses.

CANNES FILM FESTIVAL (from May 17 to May 28, 2006): Bignon Lebray & Associés, in association with Lawfort, has sponsored a luncheon-discussion on Monday, May 22 at “Le Goéland” restaurant, on La Croisette. On this occasion, the firm’s intellectual property department has exposed the various questions and issues at stake in connection with the new media (mobile telephone, Internet...).

June 2006 : Competition Law and collective management rights

The Bignon Lebray Competition, Distribution and Intellectual Property departments had the chance to coordinate several articles in the “Tendances” rubric of the “Revue des Droits de la Concurrence” (a review specialized in Competition Law).
We would like to thank Mr Nicolas Charbit, Managing Editor of the review “Concurrences” to have granted us the possibility to present the points of view of the different parties concerned by the burning topic of Competition Law application to intellectual property rights, and more particularly, to their collective management.
Within the framework of several partnerships concluded between the review “Concurrence” and some editors, two conferences dedicated to highlight topics are organized after each publication : they offer to the specialists and the concerned parties the opportunity to meet each other and to exchange.
