[COVID-19] Export of medical products from China in the fight against the epidemic

On 31 March 2020, a new regulatory text was published in China by the Ministry of Commerce, the General Administration of Customs and the National Drug Administration. Presented in the form of a public announcement, this text deals with the orderly development of the export of medical equipment (No. 5 of 2020).

In the context of the global spread of the COVID-19 epidemic, the objective of this new text, which came into force on 1st April, is clearly stated: to more effectively support the export from China of the products needed to combat the new coronavirus and to contribute to the global health emergency.

The export of medical supplies in this context must be ordered.
Chinese medical equipment export companies must guarantee the quality and safety of the products, which must meet the relevant standards and requirements in order to actively support the international community in the fight against the epidemic.

Here is how it has been applied in practice since 1st April 2020:

  • – A written or electronic declaration is required for the export of new coronavirus detection reagents, medical masks, medical protective clothing, and infrared respirators and thermometers. A declaration template is also attached to the text of the Announcement.
  • – Exported products must be covered by the Chinese medical product registration certificate and must also comply with the standards of the importing country.
  • – Customs is responsible for inspecting them and then issuing a certificate of registration of the medical device approved by the drug regulatory authority.

The public announcement states that these quality control measures for medical export supplies will be adjusted as the epidemic situation evolves.
